MEMORANDUM OF SETTLEMENT

This MEMORANDUM OF SETTLEMENT is entered into this 8th day of March, 2004, by the appointed bargaining representatives of Greater Victoria Labour Relations Association on behalf of Greater Victoria Public Library Board AND the bargaining representatives of the Canadian Union of Public Employees, Local 410.

The parties signatory hereto agree to recommend to their respective memberships and principals, without reservation, the ratification of the following terms and conditions to extend the existing collective agreement.

1 - PREVIOUS CONDITIONS

All of the terms and conditions of the collective agreement(s) commencing January 1, 2001 and expiring December 31, 2004 shall continue to apply except as specifically varied below.

2 - EFFECTIVE DATE OF CHANGES

All amendments to the revised collective agreement(s) shall come into effect the first day of the month following the date of ratification by both parties unless specified otherwise within.

3 - TERM OF AGREEMENT

The parties agree that term shall be revised to provide for a two (2) year extension to the collective agreement from January 1, 2005 to and including December 31, 2006.

4 - PENSION PLAN

The parties agree to amend article 24.03(i) by preserving the existing clause and insert the following provision as 24.03(ii), and renumber accordingly.

"Effective January 1, 2006, all newly hired regular employees shall participate under the Municipal Pension Plan, subject to the terms and conditions of such Plan, from their initial date of hire as a regular employee."

5 - WAGE INCREASES

January 1, 2005- 2%
January 1, 2006- 2%

6 - COLA

January 1, 2005- 0.5% cap with trigger of 2.0% based on 2004 Victoria CPI
January 1, 2006- 0.5% cap with trigger of 2.0% based on 2005 Victoria CPI
and any increases shall be added to the basic hourly wage rates.

7 - EYE EXAMINATIONS

The parties agree that the Extended Health Care Plan shall be amended, effective April 1, 2006 to include eye examinations to a maximum of seventy-five dollars ($75.00) every two (2) years.

8 - JE/PE FUNDING

The parties agree that Letter of Understanding No. 10 - Pay Equity shall be amended as follows:

  1. Effective July 1, 2005 the wage rates of Schedule "A" and "B" Pay Band 2 through and including Pay Band 18 shall be improved by one (1%) per cent, and
  2. Effective July 1, 2006 the wage rates of Schedule "A" and "B" Pay Band 2 through and including Pay Band 18 shall be improved by one (1%) per cent.
